Consultation starts on pub companies and tenants

The government have announced a consultation about ensuring that the relationship between pub companies and tenants is a fair one. This is in response to a resolution passed in the House of Commons in January calling for fair dealing between licensees and pub companies.

The consultation asks whether a Statutory Code, along with an independent Adjudicator, would be beneficial to the relationship between large pub companies and their tenants. At the heart of the proposed Code is a fair dealing provision along with a principle that ‘a tied tenant should be no worse off than a free-of-tie-tenant’. The model for the proposed Adjudicator is the Groceries Code Adjudicator and it would be able to arbitrate individual disputes, and conduct investigations into violations of the Code and impose sanctions if pub companies are found to be in breach.

“Pubs can be at the heart of local communities and when they close it can damage the ties that bind people together. Sometimes a pub closing can be because the relationship between a licensee and the pub company breaks down with disputes over the cost of beer and spirits. Having a statutory code, and independent adjudicator to enforce it, will help to ensure the system is fair for all. I hope that people take the opportunity to respond to the consultation.”

The consultation will close on 14th June 2013
